Luján Statement on House Vote to Undermine the Americans with Disabilities Act

[Washington DC] – Congressman Ben Ray Lujan (D-NM) released the following statement today after voting against the ADA (Americans with Disabilities Act) Education and Reform Act of 2017 (H.R. 620) which would undermine protections for people with disabilities:

“The Americans with Disabilities Act was landmark civil rights legislation that enables Americans with disabilities to participate more fully in society. The ADA Education and Reform Act would set back much of the progress made in the 27 years that have passed since the ADA became law. Although the ADA requires businesses to be more accessible, people with disabilities still often face barriers to full accessibility and, unfortunately for both parties, litigation is often the only recourse to spur compliance. This bill would create additional hurdles for people with disabilities attempting to ensure their rights are respected.

“This bill fails to address concerns about frivolous lawsuits and would not stop frivolous suits from being filed. Instead, it creates a burdensome bureaucratic process that shifts the burden of acting from businesses who are not in compliance with the law to people with disabilities trying to ensure they have the same rights of access as others. This bill removes incentives for businesses to comply with the ADA. If Congress wants to address nuisance lawsuits, there is a better way than a bill that chips away at the rights of the disabled.”
